Fair Use*

Fair Use uses a four factor test in determining whether or not a particular use is fair. The law states that at least four factors should be taken into should be taken into consideration:

  1. The purpose and character of the use
  2. The nature of the work
  3. The amount and substantiality of the portion used in relation to the work as a whole
  4. The effect of the use on the market or potential market for the original work

 

  • How does an understanding of Fair Use affect one’s role as an online instructor?

If the instructor is going to use copyrighted material in his instruction, he should give credit to the author of the material

  • How do Fair Use and the TEACH Act correlate to the delivery of reliable content?

It can enhance instruction because your have multiple resources to reference your instruction
